§ 1 Scope and Provider

(1) These General Terms and Conditions apply to all orders placed by customers via the online shop of BusTruckParts, operated by:

(hereinafter referred to as 'Seller').

(2) A customer within the meaning of these terms and conditions may be either a consumer or an entrepreneur. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

(2) By clicking the 'Buy Now' button (or a similarly clear formulation), you place a binding order for the goods contained in the shopping cart. We will confirm receipt of your order by an automated email immediately after the order is sent; this confirmation constitutes acceptance of the order. The purchase contract is concluded with this email confirmation.

§ 3 Prices and Shipping Costs

(1) The prices stated on the product pages include the statutory Value Added Tax (VAT) and other price components, unless otherwise stated (e.g., for export outside the EU where 0% VAT may apply).

(2) In addition to the stated prices, we charge shipping costs for delivery. The shipping costs will be clearly communicated to you in the shopping cart system and on the order page.

§ 4 Payment Terms

(1) Payment can be made by bank transfer, credit card, or PayPal.

(2) If the payment method 'Prepayment' (Bank Transfer) is selected, we will provide you with our bank details in the order confirmation and deliver the goods after payment has been received.

§ 5 Delivery

(1) Delivery is made to the delivery address provided by the customer.

(2) Order processing generally takes place within 1-3 working days after receipt of payment. The subsequent delivery time depends on the destination country and the selected shipping method. We ship worldwide to over 150 countries.

§ 6 Retention of Title

The goods remain our property until full payment has been made.

§ 7 Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (TruckParts Eesti OÜ, Betooni 8, 13816 Tallinn, Estonia, Email: [email protected], Phone: +372 506 9299) by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be incurred any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§ 8 Warranty and Guarantee

(1) Statutory warranty rights apply. For consumers within the EU, the statutory warranty period for new goods is two years, and for used goods, it is limited to one year from delivery of the goods.

Special Commercial Warranty: Notwithstanding the statutory rights, BusTruckParts (TruckParts Eesti OÜ) offers an extended 6-month warranty on our used parts (engine, gearbox, differential), doubling the previous market standard. This ensures that our parts have undergone quality control and are durable.

(3) For business customers (Entrepreneurs), the warranty period for new goods is one year. Claims for defects in used goods are excluded for business customers, except where explicitly covered by the 6-month commercial warranty mentioned in § 8 (2) or as agreed in the order confirmation.

§ 9 Liability

(1) We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are liable for damages resulting from injury to life, body, or health.

(2) In all other cases, liability is limited to the foreseeable, typically occurring damage. Liability in accordance with applicable Product Liability Laws remains unaffected.

§ 10 Data Protection

We collect, process, and use your personal data in accordance with the statutory provisions (GDPR). Detailed information can be found in our separate Privacy Policy.

§ 11 Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/.

§ 12 Final Provisions

The laws of the Republic of Estonia shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
